I. Information which constitutes your personal data (hereinafter referred to as your Basic data) provided in the application form to be included in the Job Seekers Database and in the documents attached with the form, as required by the Labor Code or by other particular Acts (as specified in the advert) shall be processed in line with existing laws and must be provided to take part in the recruiting process. Other personal data (hereinafter referred to as Additional data), e.g. your personal data such as your likeness or hobbies outlined in the documents, shall be processed pursuant to your voluntary consent that you give by submitting your recruitment application. Additional data may be provided voluntarily and shall not affect whether you will be allowed to take part in the recruitment process. In connection with the above, if you do not wish to have your Additional data processed by us as part of the recruiting process, please do not include it in the documents you send us. If you are interested in electronic processing of the hiring/ collaboration process via the “HRM” LeasingTeam Platform, please give your consent at the bottom of the application form. The “HRM” LeasingTeam Platform is an IT system used to support the management of personnel & administrative processes of Grupa LeasingTeam"s employees and collaborators. Among others, the Platform provides on-going online access to employee/ job seeker data, to temp worker/ potential temp worker data, to contractor/ potential contractor data and/ or to collaborator/ potential collaborator data and enables seamless processing of vacation requisitions, job absence tracking, worktime tracking, access to certificates of employments, to payslips, to Personal Income Tax forms. Consent is voluntary and will not affect whether the individual will be allowed to take part in the recruitment process to fill the advertised position (it shall not be held against the candidate and shall not form the basis for refusal to hire). Under a Joint Controller agreement made between the above mentioned companies of Grupa LeasingTeam, we have agreed, among others, the scopes of responsibility as regards fulfilling the obligations set forth in the GDPR by the particular companies; specifically we have agreed that: 1) The leading company in the joint data control model shall be Onca sp. z o o, who is responsible for on-going personal data management, for personal data protection and updating. Moreover, it oversees personal data processing processes, identifies personal data processing risks and, accordingly, sets security standards to ensure appropriate protection of all personal data being processed in Grupa LeasingTeam. In particular, ONCA sp. z o o is responsible for executing its information obligation in relation to your and for enabling you to exercise your rights, as defined below. Notwithstanding this provision, you may also choose to exercise your rights with regard to each of the Joint Controllers. ONCA sp. z o o"s core business is to deliver and maintain IT infrastructure, to award/ withdraw licenses to the systems being used by Joint Controllers, to store data, to implement technical security measures, to operate servers and to create backup copies. ONCA sp. z o o is also responsible for operating the LeasingTeam “HRM” Platform software, which constitutes a proprietary system of personnel & administrative process support for employees and collaborators. The Platform provides on-going online access to employee and collaborator data and, among others, allows for the seamless handling of vacation requests, tracking of work absences, worktime tracking, access to employment certificates, to payroll slips and Personal Income Tax forms. 2) LeasingTeam sp. z o.o., LeasingTeam Professional sp. z o.o., „LeasingTeam Provider” sp. z o.o., LeasingTeam Outsourcing sp. z o.o., LeasingTeam Brand Management sp. z o.o., IT LeasingTeam sp. z o.o., CPC Consulting Group sp. z o.o., CPC Consulting Group spółka z ograniczoną odpowiedzialnością sp. k., Go West & Co. sp. z o.o., Ananke Business Communication sp. z o.o., Finance B2B sp. z o.o., BPOTeam sp. z o.o., LeasingTeam GmbH, ONCA sp. z o.o. are responsible for current and future recruiting processes as well as for associated hiring processes and for the initiation of a collaboration with natural persons who have submitted their applications with the aim of finding a job/ starting a collaboration. 3) LeasingTeam Brand Management sp. z o.o. is responsible for the marketing and promotion of Grupa LeasingTeam"s products and services, including for the delivery of direct marketing services. For what purposes and on what basis will we use your personal data? 1. Your personal data shall be processed by Joint Controllers in line with the above discussed split of responsibilities, for the purpose of running a recruitment process for the advertised position, and specifically: a. in relation to Personal data, the legal basis for the processing shall be article 22¹ § 1 of the Labor Code pursuant to article 6, point 1, item c) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the European Union L 119, p.1), hereinafter referred to as GDPR, namely that the processing is necessary to exercise the data controller"s legal obligation. b. in relation to Additional data, the legal basis for the processing shall be your consent (legal basis: article 6, point 1, item a, of GDPR). Should you give your consent for your application to be used for future recruitment purposes, the legal basis for the processing of your personal data for future recruitment purposes shall be your consent (legal basis: article 6, point 1, item a, of GDPR). 2. Your personal data shall be processed by Joint Controllers, in line with the above discussed split of responsibilities, to run and handle the hiring process for the advertised position, specifically: a. in relation to employees/ collaborators – to execute an agreement made with the employee/ collaborator, legal basis: 221 § 2 of Labor Code pursuant to article 6, point 1, item b of GDPR). b. in relation to the obligations as foreseen by law, including labor law, social insurance regulations, regulations on the hiring of temporary workers, regulations on medical insurance, on taxes, on workplace accidents, on employee benefits fund, on accounting, on the general defense obligation (legal basis: article 6, point 1, item c of GDPR and section 9, point 2, item b of GDPR), c. in relation to employees/ temporary employees/ contractors/ collaborators, for the purpose of operating the “HRM” LeasingTeam Platform pursuant to individual consent – legal basis: article 6. point 1, item a of GDPR; d. in relation to the on-going operations of Joint Controllers: managing development and human resources, including upgrading qualifications, generating reports, analyses and statistics as needed by Joint Controllers and as related to their core business, reviewing complaints, reporting, handling administrative tasks, data filing and hardcopy and electronic (including scanned) queries/ correspondence handling, ensuring security and protection of assets (legal basis: legitimate interest of Controller, pursuant to article 6, point 1, item f of GDPR), e. in relation to the pursuit of marketing objectives – pursuant to consent granted (legal basis: article 6, point 1, item a of GDPR). V. Right to Withdraw Consent If you consent to having your Additional data processed or consent to having your application used for future recruitment purposes, you shall have the right to withdraw either (or both) consents at any time, without this affecting compliance with the processing law. If you consented to having your personal data used in the LeasingTeam “HRM” Platform for the purpose of running the Platform, you have the right to withdraw your consent at any time without this affecting compliance with the processing law. If you consented to having your data provided to Joint Controller business partners for recruitment purposes, to initiate an employment relationship or a collaboration, you have the right to withdraw this consent at any time without this affecting compliance with the processing law. If you consented to having your personal data processed for marketing purposes, you shall have the right to withdraw this consent at any time without this affecting compliance with the processing law. Should a given consent be withdrawn, the data covered by the consent and processed based on that consent will be immediately deleted. If you gave your consent to receiving marketing information, including current job offers related to future recruiting projects electronically (in particular via e-mail) from companies part of Grupa LeasingTeam, you shall have the right to withdraw your consent at any time. If you consented to having companies part of Grupa LeasingTeam send you marketing information, including current job offers, by phone, e.g. via text messages and phone, you shall have the right to withdraw this consent at any time. VI. Processing Period Personal data collected for the purpose of running a recruitment process shall be processed until the recruitment process is completed and shall be deleted within 3 months from recruitment completion, at the latest. Personal data processed based on consent given to future recruitment activities shall be processed for a period of 3 years from the date it had been obtained. If consent is withdrawn – when processing is made pursuant to consent – these data shall be immediately deleted. Personal data processed in connection with hiring or the start of a collaboration shall be processed for the required period of time or for the period of time permitted by law. Personal data used as part of the LeasingTeam “HRM” Platform will be processed until you withdraw your consent to its processing. The period of time personal data is processed for may be extended each time by the period of limitations if personal data processing proves essential to pursuing potential claims or to defend against such claims by the Data Controller. VII. Data Recipients Categories of personal data recipients: Joint Controller business partners, providers of IT services such as hosting, providers of IT systems, providers of accounting systems. VIII. Profiling Your personal data shall be processed in an automated manner (including by profiling). Personal data profiling involves data being processed (including processed in an automated manner) by using it to evaluate some information about the data subject, in particular to analyze or predict aspects concerning that person"s education, personal preferences related to employment or collaboration and professional experience. The use of profiling does not automatically lead to decisions being made regarding participation in a recruitment process. Profiling for this purpose is applied based on the legitimate interest of Joint Controllers (legal basis: article 6. point __, item f of GDPR), which involves searching for and grouping job seekers who best match a given position or collaboration model (e.g. due to their level of education or professional background). You can object to having your personal data processed automatically (including via profiling) at any time. When an objection is submitted and is ruled justified, personal data subject to automated processing (including to profiling) will be deleted. IX. Other You have the right to demand from the Data Controller access to your personal data, the right to have it corrected, removed or to have its processing restricted, the right to have it transferred and – in relation to the processing of your personal data for the legitimate interest of the Data Controller, pursuant to article 6, point 1, item f of GDPR – the right to object. You also have the right to file a complaint with a supervisory authority (President of Personal Data Protection Office). Please be informed, that Joint Controllers will not be making automated decisions based on your personal data.
