Information concerning the processing of job candidates' personal data
Dear Sir/Madam
In fulfilling the obligation referred to in Article 13 (1) and (2) and 14 (1) and (2) of the General Data Protection Regulation of 27 April 2016 (hereinafter referred to as GDPR), acting as a personal data controller, in this print we provide information required by the above mentioned regulations concerning the processing of your personal data.

Personal data controller
Your personal data controller is METRO SERVICES PL sp. z o.o. with its registered office in Szczecin at ul. Ku Słońcu 67 (61-041 Szczecin).
Personal data protection officer and contact point
METRO SERVICES PL sp. z o.o. has appointed a Data Protection Officer. In matters related to the processing of your personal data, and also in matters related to the implementation of an extensive catalogue of data subjects' rights, you can contact the officer via e-mail, i.e.: data.protection@metro-services.pl.
The Capital Group, to which METRO SERVICES PL sp. z o.o. belongs, has also appointed a Data Protection Officer, who can be contacted via e-mail, i.e.: datenschutz@metro.de.
Source of origin
In some cases we will process your personal data which have not been obtained from you. Then the source of origin of your personal data is a recruitment agencies, which helps METRO SERVICES PL sp. z o.o. in recruitment process.
Purposes of the processing of personal data and legal grounds for the processing
We will process your personal data for the following purposes and in accordance with the legal grounds set out below:
a) the recruitment process - legal grounds for the processing: consent of the data subject - Article 6 (1) (a) of the GDPR, action taken at the request of the party before the conclusion of the contract - Article 6 (1) (b) of the GDPR and fulfilment of the legal obligation imposed on the controller - Article 6 (1) (c) of the GDPR in connection with, among others, Article 221 (1) of the Labour Code,
b) carrying out future recruitment processes - legal grounds for processing: consent of the data subject - Article 6 (1) (a) of the GDPR, and in case of actual commencement of the next recruitment process also: action taken at the request of the party before the conclusion of the contract - Article 6 (1) (b) of the GDPR and fulfilment of the legal obligation imposed on the controller - Article 6 (1) (c) of the GDPR in connection with, among others, Article 221 (1) of the Labour Code,
c) protection against claims – legal grounds for the processing: legitimate interest of the data controller – Article 6 (1) (f) of the GDPR.
Personal data categories
If your personal data does not obtain from you directly, then as the data controller, in accordance with Article 221 (1) of the Labour Code, we will process the following catalogue of your data: name [names] and surname, parents names, date of birth, place of residence [correspondence address], education [name of the school and year of its graduation, occupation, specialty, academic degree, title vocational, academic title], complementary education [courses, post-graduate studies, date of graduation or date of commencement of education in the case of its duration], current employment [periods of employment with subsequent employers and positions held], citizenship, additional qualifications, skills [e.g. level of foreign languages, driving license, computer skills], interests, series and number of ID card [also indicating the authority which issued the abovementioned identity card] or information about another identity document. However, if you have decided to provide us with a broader catalog of data, we would like to inform you that we process it on the basis of your consent and these data do not affect the final results of the recruitment process.
Recipients of data
METRO SERVICES PL sp. z o.o. operates within the METRO group of companies. As we execute some of our business processes together, your personal data may be transferred to companies in the METRO Group. In addition, your personal data processed in connection with your future employment may be transferred to other recipients, such as, but not limited to, processors, i.e.:
a) an entity supporting our recruitment processes (also through the delivery of an interactive platform), or an entity providing HR and payroll services, an entity destroying documentation, entities providing and operating our systems and IT infrastructure, or an entity providing a tool for competence testing, as well as, possibly, entities providing consulting services.
Transfers of data to third countries
Your personal data processed in connection with the recruitment process may be transferred to third countries, i.e. outside the EEA (we do not plan to transfer your personal data to international organisations). This transfer is made in connection with the above action and the cooperation of METRO SERVICES PL sp. z o.o. with the companies of the METRO Group.
The transfer of personal data takes place on the basis of agreements regulating the mutual cooperation of companies from the METRO Group. An adequate level of security of your personal data is ensured by the use of standard contractual clauses, which are annexed to the above mentioned contracts.
Retention period for personal data
Your personal data will be stored:
e) when the recruitment process resulted in rejection of your application and you did not agree to participate in future recruitment processes, for a period of 14 days from the date of rejection,
f) when the recruitment process resulted in the rejection of your application, and you agreed to participate in future recruitment processes, for a period of two years from the date of entering your data in the database of candidates,
g) if you withdraw your consent to the processing of personal data at the moment of examining your application, but not later than by the expiry of the period of limitation of claims,
h) when the recruitment process has been successfully completed, a part of the data contained in the recruitment documents may be included in the personal files, and the processing period will be extended by the time of employment relationship completion and the period determined by separate provisions to the extent that it shapes the process of storing the employee's personal files.
Employee rights with regard to the processing of personal data
You have the following rights in connection with the processing of your personal data:
h) access to your personal data,
i) rectification of your personal data,
j) deletion of your personal data,
k) limitation of processing of personal data,
l) right to transfer data,
m) right to lodge a complaint with the Office for the Protection of Personal Data

We suggest that you implement an extensive catalogue of your rights through the contact box referred to in point 2.
Remember that you will not be able to exercise some of these rights in relation to personal data processed by the controller in order to fulfil its obligations under the law. You will be able to obtain more information on this subject through the contact box referred to in point 2.
You also have the right to withdraw your consent at any time, without affecting the lawfulness of any processing that has been carried out on the basis of the consent prior to its withdrawal.
Provision of data
If you will provide personal data necessary to participate in the recruitment process directly via our platform,(i.e. those referred to in Article 221 (1) of the Labour Code) we inform that this providing is mandatory if you want your application to be taken considered. If you refuse to provide this information, your application will be rejected.
Providing other personal data, not indicated in art. 221 (1) of the Labour Code is voluntary and does not affect the recruitment process.
If you want to participate in future recruitment processes, we process your data on the basis of your consent, the expression of which is voluntary.
Information on automated decision making
Please note that we do not apply the automated decision-making process, including profiling, to candidates.
